Isle Of Wight Child Rapist's Sentence NOT 'Unduly Lenient'

A convicted child rapist, from Freshwater, will not have his sentence referred to the Court of Appeal.

The Solicitor General says it was "shocked" by Graham Medway's crimes, but the threshold to consider his sentence 'unduly lenient' had not been met.

As Isle of Wight Radio previously reported, Mr Medway was jailed for 14 years following a "horrific" serious sexual assault in August at Fort Victoria Country Park, Yarmouth.

His case was referred to the Attorney General after calls were made to give him a longer sentence.

However, it has been confirmed that the case will not be sent to the Court of Appeal. 

A spokesperson for the Attorney General’s Office said:

“The Solicitor General was shocked by this case and wishes to express his deepest sympathies to the victim and their family.

“After careful consideration the Solicitor General has concluded that he could not refer this case to the Court of Appeal. A referral under the Unduly Lenient Sentence scheme to the Court of Appeal can only be made if a sentence is not just lenient but unduly so, such that the sentencing judge made a gross error or imposed a sentence outside the range of sentences reasonably available in the circumstances of the offence. The threshold is a high one, and the test was not met in this case.”

At a sentencing hearing, Judge Hetherington said he took Mr Medway's guilty plea into account - reducing his sentence by 25%.

This took his 12-year sentence down to nine years.

Another five years was then added because of additional factors in the case, which is due to be served on license.
